Alina Habba has left her position as the chief federal prosecutor in the state. This follows a court battle that invalidated her legal standing to serve.

Attorney General's Statement

The nation's top law enforcement official, Pam Bondi, announced the prosecutor's departure on the start of the week. Bondi stated that the appeals court finding made it unworkable for Habba to lead the department effectively.

"Do not interpret following the order as giving up," Habba stated. "This battle will now extend throughout the country."

Judicial Challenge

Habba's exit comes a week after a federal appellate panel determined that she had been acting without proper authority as US attorney. This ruling is likely to affect many prosecutions in New Jersey.

The appellate judges ruled that a interim role that did not receive Senate approval violated the Federal Vacancies Reform Act.

Ongoing Legal Battle

It was also stated that Habba will continue working within the justice department as a high-level advisor. They intend to seek further review of the disqualification, with hopes of a overturned decision.

On a social media platform, Bondi contended that judges "cannot be permitted to second-guess the President's choice of lawyers tasked with performing the primary duty of the administration of enforcing the law."

The attorney general commended the prosecutor's work and noted that under her leadership, the Newark saw a significant drop in crime. It was also reported that the Camden recorded its first summer in half a century free from homicides.

Connection to Donald Trump

Habba, was initially recruited to the former president's legal defense in 2021. She later represented Trump in his business records case in New York last year, when he was conviction on multiple felony counts of document fraud.

Earlier, her appointment to the top New Jersey post, Trump had revealed he was selecting her as his presidential counsellor if re-elected, describing the lawyer as a steadfast ally and a dedicated fighter for justice.
