US Court Mandates Freedom of Abrego Garcia from ICE Custody

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.

The situation originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to face human smuggling charges, he was detained in federal custody.

In her decision, the court noted that the government lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
